The First Amendment of the U.S. Constitution, as interpreted by the U.S. Supreme Court, provides the strongest guarantee of free speech in the world. Unlike people in many other countries, Americans are free to criticize each other and government officials in language both fair and foul, to engage in racist or other hateful speech, and to use expletives and other bad language in public. In some states, like California, they may even exercise their right to free speech on other people's private property. Americans are very proud (some foreigners would say inordinately) of their right to free speech; most of them feel that it encourages a strong free press which regularly cleanses corruption out of American government (e.g., Watergate) and thus ensures its unique stability.

By the early years of the republic when the U.S. system of checks and balances was devised, a daring journalistic community had already become established. A bold and scrappy press was an influential force in denouncing the rule of an English King and leading Colonial America into its revolution against the British Empire. With journalistic freedom protected in the 1791 Bill of Rights, the press became an assertive force during the first decades of nationhood. The U.S. media today is frequently known as the Fourth Estate, an appellation that suggests the press shares equal stature with the three branches of government created by the Constitution. But although the press was not established as an institution by the U.S. constitution, today many citizens believe that it constitutes a branch of U.S. government. Numerous debates still rise regarding press's freedom to act as a watchdog of the American government. Is it protected by law?

Several critical court cases have been landmarks in establishing the rights of the press to pursue information and to publish government documents or derogatory information about public figures. The U.S. Supreme Court has held that the media should have some First Amendment protection from the laws of libel for fear that lawsuits and possible monetary damages might disincline media owners from fully reporting on public matters. In order for a public figure to win a defamation case against a media defendant, the plaintiff must show "actual malice," which the courts have defined as knowledge that the published statement was false or as "reckless disregard of whether it was false or not".

In our time, American free speech law has become an issue of international appeal since the Internet rose as another main medium of communication. Probably, this is because many banned groups can take advantage of Internet service providers based in the United States to send their messages around the world, even where such speech is banned. U.S. courts will not enforce foreign judgments contrary to domestic public policy, including the liberal U.S. policy on free speech. As for the U.S. perspective, many Americans dislike attempts by common law jurisdictions to extend their personal jurisdiction to American defendants whose alleged defamatory speech acts occurred over the Internet and were not targeted towards those jurisdictions. If the First Amendment cannot protect them, what else can? Is diplomacy a solution? The fact remains that political and social scientists seem to have set off in unknown waters.

I can't tell you how often people come up to me and say, "Tell me how to write a book about my life." You've got your life story to tell, and you can make it a best seller.

I get goose bumps every time I hear that someone is going to write their life story or biography. Your own personal history could be one of the most important books you ever write. Your family background and heritage has essential information for you, your immediate family and those hundreds of people who are (and will be) your children, grandchildren, great grand children and... well, you get the idea.

When I hear that someone will be writing about their lineage, their ancestors, children, jobs, and lifestyle, I know I'm talking to someone who really knows the value of that kind of information. And my job is to make it as easy as possible. My job is to help you put it in book form so it becomes more than just a diary or a journal.

Everyone who wants to write a book knows they have at least one best seller in them. And the best seller that should come to mind first is your life story. I cant tell you hlw many people come up to me and say they want to write a book about their life story.

But they get it wrong.

They always feel that just because theyve lived a life, their life is worth reading about. Nothing could be further from the truth. Most of us, even the most exciting and the most celebrated among us, do not lead lives worth reading about. If you ever had the chance to follow your idol through a day in his or her life, youd be bored to tears by the time you reached the end of the day. Turns out these folks have the same hum drum lives that just about everybody else has.

The difference, however, is that they have pockets, pieces or parts of the day (or week, or month, or year) that are unbelievably exciting. And when you read about these folks, these exciting bits are the only ones you get to know about. Because, frankly, these exciting bits are the only ones anyone is worth reading about.

And so it is with you. Your live is probably a collection of not much happened today entries into your diary. But over the years, youve accomplished a great deal. When you look back on it, you may have done some things that are pretty extraordinary. In fact, Id be willing to bet that you have.

These are the things you want to write about. Dont write about the hum drum, people get enough boredom from their own lives. Write about the humdinger. And thats usually a collection of things that youve been doing over the years to accomplish a goal, or reach a particular level of success.

Maybe youve survived cancer, maybe youve saved enough money to buy a rental property, maybe you overcame depression, or maybe you spend the last few years caring for a child or an adult who tested both your patience and your skills. Maybe you got a great promotion, maybe you overcame an addiction.

And if you havent achieved anything in life yet (something Id strongly disagree with) then pick the thing youd like to accomplish and start writing the book that profiles how you are accomplishing it right now.

When people read fiction, they want a story and entertainment and escapism.

When people read non-fiction (and that includes your life story) they want solutions to their problems. So provide them with those solutions. Not just the attempts that worked, but also the ones that didnt work and why they didnt work. When youre finished, you want to hand your reader a manual for the accomplishment of that goal. Now, you may call it your life story, but its a manual for the reader.

I strongly suggest you not talk about how poor you were unless your poverty has a direct impact on either your situation, or your solution. Maybe you were so poor when you were young that your family couldnt buy pies at the store so you and your mother made them from scratch. And that was the start of your pie-baking story that is now so successful.

Youll quickly understand that there is more than one book inside you. Youve done several things and youve done a lot with your life. Make each of these accomplishments the basis of a new book.

Spyware - Adware - Scumware, The "Hezbollah" of the Computing World!

Yes, the world of computing has it's own "Hezbollah", called Spyware, Maleware, and Scumware. Like the terrorist group among civilians, these programs "hide" among legitimate downloads and upgrades you make on a daily basis. If you are connected to the internet you have been exposed to, and almost certainly already have, a Hezbollah/Spyware/Maleware/Scumware program living right along side one of your favorite programs as we speak! These programs are almost as hard to get rid of as the Hezbollah and not nearly as nice.

I wrote this article out of shear frustration!! Having just finished (I Hope) the removal of the last remnant of a particularly bad Spyware infection. It started when I decided to take a look at a "music" download service - you know the type - the kind that let you "download all you want!" I downloaded something all right. First came the popups - I couldn't close them fast enough, then I noticed my home page was NOT Google Search anymore but some God awful Male Enhancement site, then came the emails - sex sites, gambling sites, advertisements of all shape, size, and color and did I say SEX sites - I had no idea how many males suffer from small.... well you get the picture. I then noticed my computer had become soooooo....slooooow... it would churn and churn as the Male Enhancement ads and the Viagra ads - just kept coming!

I NEEDED HELP and NOW!!

The more I read about the culprits Spyware - Malware and Scumware as they have been affectionately called the more I began to worry - these guys were SERIOUS about their mischief! I tried all the free softwares I could find to get rid of them but even after I rebooted the little devils reinstalled themselves. I knew I was in over my head and the enemy was very very good at their craft, I even had one Spyware "killer" program that installed it's own Malware on my system and sent me to a site to "Buy" the only fix for the Problem - UNBELIEVABLE!!

Why Do I Feel Like Somebody's Watching Me?

Spyware is one of the fastest-growing Internet threats. According to the National Cyber Security Alliance, Spyware infects more than 90% of all PCs today. These unobtrusive yet malicious programs are designed to silently bypass firewalls and anti-virus software without the user's knowledge. Once embedded in a computer, they can wreak havoc on the system's performance while gathering your personal information. Fortunately, unlike viruses and worms, spyware programs do not usually self-replicate.

Where do they come from?

Typically, Spyware originates in three ways. The first and most common way is when the user installs it. In this scenario, spyware is embedded, attached, or bundled with a freeware or shareware program without the user's knowledge. The user downloads the program to their computer. Once downloaded, the Spyware program goes to work collecting data for the spyware author's personal use or to sell to a third-party. Beware of many P2P file-sharing programs. They are notorious for downloads that possess spyware programs.

The user of a downloadable program should also pay extra attention to the accompanying licensing agreement. Often the software publisher will warn the user that a Spyware program will be installed along with the requested program. Unfortunately, we do not always take the time to read the fine print. Some agreements may provide special "opt-out" boxes that the user can click to stop the spyware from being included in the download. Be sure to review the document before signing off on the download.

Another way that Spyware can access your computer is by tricking you into manipulating the security features designed to prevent any unwanted installations. The Internet Explorer Web browser was designed not to allow websites to start any unwanted downloads. That is why the user has to initiate a download by clicking on a link. These links can prove deceptive. For example, a pop-up modeled after a standard Windows dialog box, may appear on your screen. The message may ask you if you would like to optimize your Internet access. It provides yes or no answer buttons, but, no matter which button you push, a download containing the Spyware program will commence. Newer versions of Internet Explorer are now making this Spyware pathway a little more difficult.

Finally, some Spyware applications infect a system by attacking security holes in the Web browser or other software. When the user navigates a webpage controlled by a Spyware author, the page contains code designed to attack the browser, and force the installation of the Spyware program.

What can Spyware programs do?

Spyware programs can accomplish a multitude of malicious tasks. Some of their deeds are simply annoying for the user; others can become downright aggressive in nature.

Spyware can:
1. Monitor your keystrokes for reporting purposes.
2. Scan files located on your hard drive.
3. Snoop through applications on your desktop.
4. Install other Spyware programs into your computer.
5. Read your cookies.
6. Steal credit card numbers, passwords, and other personal information.
7. Change the default settings on your home page web browser.
8. Mutate into a second generation of Spyware thus making it more difficult to eradicate.
9. Cause your computer to run slower.
10. Deliver annoying pop up advertisements.
11. Add advertising links to web pages for which the author does not get paid. Instead, payment is directed to the Spyware programmer that changed the original affiliate's settings.
12. Provide the user with no uninstall option and places itself in unexpected or hidden places within your computer making it difficult to remove.

Spyware Examples

Here are a few examples of commonly seen Spyware programs. Please note that while researchers will often give names to Spyware programs, they may not match the names the Spyware-writers use.

CoolWebSearch, a group of programs, that install through "holes" found in Internet Explorer. These programs direct traffic to advertisements on Web sites including coolwebsearch.com. This Spyware nuisance displays pop-up ads, rewrites search engine results, and alters the computer host file to direct the Domain Name System (DNS) to lookup preselected sites.

Internet Optimizer (a/k/a DyFuCa), likes to redirect Internet Explorer error pages to advertisements. When the user follows the broken link or enters an erroneous URL, a page of advertisements pop up.

180 Solutions reports extensive information to advertisers about the Web sites that you visit. It also alters HTTP requests for affiliate advertisements linked from a Web site. Therefore the 180 Solutions Company makes an unearned profit off of the click through advertisements they've altered.

HuntBar (a/k/a WinTools) or Adware.Websearch, is distributed by Traffic Syndicate and is installed by ActiveX drive-by downloading at affiliate websites or by advertisements displayed by other spyware programs. It's a prime example of how spyware can install more spyware. These programs will add toolbars to Internet Explorer, track Web browsing behavior, and display advertisements.

How can I prevent Spyware?

There are a couple things you can do to prevent Spyware from infecting your computer system. First, invest in a reliable commercial anti-spyware program. There are several currently on the market including stand alone software packages such as Lavasoft's Ad-Aware or Windows Antispyware. Other options provide the anti-spyware software as part of an anti-virus package. This type of option is offered by companies such as Sophos, Symantec, and McAfee. Anti-spyware programs can combat spyware by providing real-time protection, scanning, and removal of any found Spyware software. As with most programs, update your anti virus software frequently. As discussed, the Internet Explorer (IE) is often a contributor to the Spyware problem because Spyware programs like to attach themselves to its functionality. Spyware enjoys penetrating the IE's weaknesses. Because of this, many users have switched to non-IE browsers. However, if you prefer to stick with Internet Explorer, be sure to update the security patches regularly, and only download programs from reputable sources. This will help reduce your chances of a Spyware infiltration.

And, when all else fails?

Finally, if your computer has been infected with a large number of Spyware programs, the only solution you may have is backing up your data, and performing a complete reinstall of the operating system.

DO NOT take the Spyware threat lightly.

It is, in my opinion, much more insidious and sneaky than the plain old Virus that most Virus software can handle. Take it from me after nearly 48 hours of trying to cleanse my system of this "stuff," - I will not be without an effective and Guaranteed method of removal again.

The Traveling Office: Organizing Your Car

"I wish I had ____ with me." You fill in the blank. How many times have you been off-site, meeting with a client, only to discover you were missing a form or a brochure that would have helped you wrap up a discussion?

Whether you are in sales, real estate, consulting or a variety of other jobs, travel is usually involved. Even when you spend most of your day in an office, you still have to travel back and forth, often bringing work with you, or you might be meeting a client for lunch, and have that, "I wish I had" comment running through your mind.

Here are some basics that would benefit everyone.

Front Seat

Calendar: Since everyone is now reachable at any time by cell phone, you would want to have a calendar handy, whether paper or electronic. If you use an electronic calendar but are not syncing with your PDA, then you can periodically print out a monthly calendar and carry that with you.

Notepad: If you have to pull over for an extended talk with a client, you want to make notes on the conversation. Do not count on storing everything in your head for later. Write it down now.

Index Cards: Carry these with you at all times. They can go in your shirt pocket, purse, briefcase, and car. Whenever something comes up that you need to do or want to remember, write it down on an index card. When you get back to the office, staple that to a full sheet of paper and place it in your Daily Action file.

Mileage Log: If you have it close at hand, you will be more likely to remember to record the miles traveled. It is so much harder to do this once a month or to recreate the data at the end of a tax year.

CDs: If you want to make good use of all the travel time, this is an opportunity to listen to recorded business books or to conference break-out sessions. On the other hand, if it is advantageous for you to relax before a meeting or while headed home, pick some music that unwinds you.

To store these materials, you might consider an auto organizer with multiple compartments, one that ties over the headrest and sits against the passenger seat. It provides easy access. When you have a passenger, you simply move it around so that it hangs in back of the seat, still within reach.

Have a zippered plastic case for extra pens, pencils, and other basic desk supplies. You do not want all of these to be loose in case of sudden stops where they could become flying projectiles.

Everyone knows that media format wars have historical significance in the world of technology. Remember the most notorious battle between the Beta max and the VHS? The winner of such battles will make millions even billions. Later we had the upgrade of tape to CD, a revolution in music. In 1980 the Philips/Sony compact disc standard was finalized and nobody has looked back for the last 26 years (until mp3's came along).

Well as ever there is a new media battle but who will win again is yet unknown. This modern forest of technological mass has produced a new insurgency: THE HIGH DEFINITION WAR. Blu-ray vs HD-DVD are two competing formats which are eventually going to replace DVD's. As you look around at your local electric retailers you can see changes happening in the broadcast world, not only are we changing from our conventional CRT screens to Flat screen but also to HD ready TV. The impact this has on our lives is not as large as black and white to colour, but nevertheless a change that will definitely be a benchmark for future media.

Why New formats?

The reason we have introduced these new formats is that your traditional DVD can hold a maximum of 9.4 GB (Dual Layer) of information. This is not enough for HD broadcast as the information required is higher, being a resolution of 1920x1080. Blu-ray discs can hold 50 GB (Dual Layer) and HD-DVD 30 GB (Dual Layer).

These new discs cannot be played on normal DVD players but on new HD media players of which examples are Samsung BDP 1000 (Blu-Ray), Sony Playstation 3 (Blu-Ray), Toshiba HDXA1 (HD-DVD). This means spending more money for better resolution.

Price

This is always important especially when new models of media come out; at first it is always expensive as supply out strips demand. The players are expensive, the cheapest being the Playstation 3 supposedly retailing at 549. Blu-Ray media also being expensive; similar to DVD's when they first came out (taking inflation into consideration), blank media costing from 11.99 to 24.99.

Hollywood movie studios Disney, Paramount, Warner, Sony, Eagle rock, Fox and MGM and Lions gate support Blu-ray also. None of these large companies would take such a gamble if they didn't know that this is what the consumer wants.

PlayStation 3

Sony love to bring out their own media whether its Sony Duo Sticks or Sony Mini Discs. Their hunger to dominate the consumer market has always been there and this is nothing different. The Playstation 3 will play Blu-Ray discs, still having the ability to play older media like DVDs and CDs. The success of the predecessor's PS1 and PS2 will give much anticipation to the release of this new console and is what Sony are hoping will convert people to use Blu-Ray. A Sony spokesman has predicted that Blu-Ray will dominate the HD market within 12 months.

The encouraging feature with HD-DVD is the name, everyone's ears will ring with the name and automatically assume that this is a high definition movie. Asking someone in the street what 'Blu-ray' is will bring looks of confusion, along with the fact that both will produce similar quality pictures.

Region Coding

Region coding with Blu-Ray may put people off; the fact that you may not be able to watch a new release from the states or Japan on your European locked regional player will raise eyebrows.

Future Proof

Realistically you only need about 15-20 GB for a feature length film in High definition but who would have known that DVD's could not be able to hold enough for high definition. Theoretically they can with MPEG-4 Compression. In any case media like Blu-ray will hopefully be future proof in years to come.

Conclusion

The timescale and price are the two main issues here, how quick we will universally change to HD and whether this is affordable. From a consumer point of view the necessity for HD doesn't seem imperative, after all VHS was around for 20 odd years twice that of DVD (so far). You could argue that technology is changing exponentially and that changes occur quicker.

As for the battle between the two media there may be compromise ahead. A UK firm has announced a solution to the media war. London-based New Medium Enterprises (NME) has developed a low-cost, multilayer DVD disc that can store Blu-ray content on one layer and HD DVD content on another. This would leave the consumer with the choice of buying either type of player to play the one disc.

The key setback I feel with the looming HD change is the cheaper alternative to a Blu-Ray player or HD-DVD player, the DVD upscaler. Do people want to get rid of those hundreds of DVDs they bought to replace them with an expensive alternative, especially when they might not even notice the difference in picture quality?

However I do feel that HD is encouraged with consoles such as the Playstation 3. Blu-ray is its main format and may revolutionise the games industry.
